1. Introduction
PinaTV respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with the law.
2. DMCA Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through PinaTV, please notify our copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:
An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
Identification of the copyrighted work that you claim has been infringed;
Identification of the material that is claimed to be infringing and where it is located on PinaTV;
Information reasonably sufficient to permit PinaTV to contact you, such as your address, telephone number, and email address;
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law;
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification
If you believe that your content was removed in error, you may file a counter-notification. To be effective, a counter-notification must be a written communication provided to our designated agent that includes substantially the following:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which PinaTV may be found, and that you will accept service of process from the person who provided notification of the alleged infringement
4. Repeat Infringers
It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights.

6. Response Time
We will respond to valid DMCA takedown notices within a reasonable time frame, typically within 48-72 hours of receipt. Upon receipt of a valid takedown notice, we will remove or disable access to the allegedly infringing material and notify the user who posted the content.
7. False Claims
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.
8. Content Removal
When we receive a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the content
- Provide the user with a copy of the takedown notice
- Inform the user of their right to file a counter-notification
9. Restoration of Content
If a valid counter-notification is received, we may restore the removed content, unless the original complainant files a court action against the user within 10 business days of receiving the counter-notification.
